Important Emergency Notice

Tourist SOS is NOT an emergency service. In life-threatening emergencies, contact local emergency services immediately (911, 112, etc.). Our platform facilitates medical coordination and support services for travelers but does not replace emergency medical services.

Acceptance of Terms

By accessing or using the Tourist SOS platform, website, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our Services.

Tourist SOS Inc. ("Company," "we," or "us") operates a comprehensive healthcare technology platform designed to streamline tourist medical emergencies, trauma cases, and healthcare coordination across Southeast Asia and beyond.

Your continued use of the Services following any changes to these Terms constitutes acceptance of those changes. We recommend reviewing these Terms periodically.

Tourist SOS provides comprehensive healthcare technology solutions including:

Tourist SOS Platform

Emergency medical assistance and coordination services for travelers

Command Center

Real-time monitoring and emergency response coordination

Patient Central

Healthcare data management and patient portal services

Mobile Applications

Tourist-facing emergency assistance applications

Our services are designed to facilitate emergency medical care, improve healthcare coordination, and enhance patient safety for travelers, healthcare providers, and government agencies across Southeast Asia including Thailand, Laos, Cambodia, Vietnam, Philippines, Indonesia, Singapore, and Sri Lanka.

User Accounts

3.1 Account Registration

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Types

We offer different account types for different user categories:

  • Tourist Accounts: For travelers seeking medical assistance
  • Healthcare Provider Accounts: For medical professionals and facilities
  • Government Accounts: For tourism and health authorities
  • Enterprise Accounts: For organizations and partners

3.3 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. Tourist SOS cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Acceptable Use Policy

4.1 Permitted Uses

You may use our Services for legitimate healthcare coordination and emergency assistance purposes.

4.2 Prohibited Activities

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful, threatening, abusive, or defamatory content
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt our Services or servers
  • Use our Services for any fraudulent or illegal activities
  • Impersonate any person or entity
  • Collect or harvest personal information from other users
  • Provide false medical information or emergency reports
  • Use the platform for non-emergency purposes during actual emergencies

4.3 Medical Information Accuracy

Users are responsible for providing accurate medical information when using our Services. Inaccurate information may compromise the quality of care and emergency response, potentially endangering lives.

Payment Terms

5.1 Subscription Services

Certain features of our Services require payment of subscription fees. You agree to pay all applicable fees as described on the Services at the time you subscribe.

5.2 Billing and Payment

  • Billing: Fees are billed in advance on a monthly or annual basis
  • Payment Methods: We accept major credit cards and bank transfers
  • Late Payments: Late payments may result in service suspension
  • Currency: All fees are quoted in USD unless otherwise specified

5.3 Emergency Services

Emergency coordination services may incur additional charges based on the level of assistance required. These will be clearly communicated before services are rendered when possible.

5.4 Refunds

Refunds are handled on a case-by-case basis. Contact our support team for refund requests. Emergency service fees are generally non-refundable due to the immediate nature of the services provided.

Intellectual Property

6.1 Ownership

The Tourist SOS platform and Services, including all content, features, and functionality, are owned by Tourist SOS Inc. and are protected by copyright, trademark, and other intellectual property laws of the United States and international treaties.

6.2 License Grant

You are granted a limited, non-exclusive, non-transferable license to use our Services for their intended purpose. You may not:

  • Copy, modify, or distribute our software or content
  • Reverse engineer or attempt to extract source code
  • Remove or alter any proprietary notices
  • Use our trademarks or branding without written permission
  • Create derivative works based on our Services

6.3 User Content

You retain ownership of any content you submit to our Services. However, you grant us a worldwide, royalty-free license to use such content for the purpose of providing our Services and improving emergency response capabilities.

Privacy and Data Protection

7.1 Privacy Policy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.2 Data Processing

By using our Services, you consent to:

  • The collection and use of your information as described in our Privacy Policy
  • The processing of your data for service delivery and improvement
  • The sharing of information with healthcare providers as necessary for emergency services
  • Cross-border data transfers necessary for international emergency coordination

7.3 Medical Data

We implement appropriate security measures to protect your personal and medical information and comply with applicable data protection laws including GDPR, HIPAA, and local privacy regulations in Southeast Asian countries where we operate.

7.4 Emergency Data Sharing

In emergency situations, we may share necessary medical information with healthcare providers, emergency services, and government authorities to facilitate appropriate care and ensure tourist safety.

Section 8

Limitation of Liability

8.1 Service Nature

IMPORTANT: Tourist SOS is a technology platform that facilitates healthcare coordination and emergency assistance. We are not a healthcare provider, emergency service, or medical facility, and do not provide medical advice, diagnosis, or treatment.

8.2 Healthcare Provider Responsibility

Healthcare providers using our platform remain solely responsible for all medical decisions, diagnoses, treatments, and patient care. Tourist SOS facilitates communication and coordination but does not influence or control medical decisions.

8.3 Limitation of Liability

To the maximum extent permitted by law, Tourist SOS shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Medical outcomes or healthcare decisions made by providers
  • Service interruptions or technical failures during emergencies
  • Actions or omissions of third-party healthcare providers
  • Delays in emergency response due to factors beyond our control
  • Inaccurate information provided by users or third parties

8.4 Maximum Liability

Our total liability for any claims shall not exceed the amount paid by you for our Services in the 12 months preceding the claim, or $1,000, whichever is greater.

Section 9

Termination

9.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account closure feature in your dashboard.

9.2 Termination by Us

We may suspend or terminate your access for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false emergency information
  • Misuse of emergency services
  • Non-payment of fees

9.3 Effect of Termination

Upon termination:

  • Your right to use our Services will cease immediately
  • We may delete your account and data after a reasonable period
  • You remain liable for any outstanding fees
  • Emergency medical records may be retained as required by law
  • Provisions regarding liability and intellectual property survive termination

Governing Law

10.1 Applicable Law

These Terms of Service are governed by and construed in accordance with the laws of Nevada, United States, without regard to conflict of law principles.

10.2 Jurisdiction

Any disputes arising from these Terms or your use of our Services shall be resolved through:

  • Primary Jurisdiction: Courts located in Reno, Nevada, USA
  • Alternative Dispute Resolution: Binding arbitration for disputes under $25,000
  • International Disputes: May be resolved in the jurisdiction where services were provided

10.3 International Considerations

Given our international operations across Southeast Asia, local laws and regulations may also apply to specific aspects of our Services in each jurisdiction where we operate.

10.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Section 11

Changes to Terms

11.1 Modification Rights

We reserve the right to modify these Terms of Service at any time. When we make changes:

  • Notice: We will provide at least 30 days' notice of material changes
  • Communication: Notice will be sent via email and posted on our website
  • Effective Date: Changes become effective on the date specified in the notice
  • Emergency Changes: Critical safety-related changes may be implemented immediately

11.2 Acceptance of Changes

Your continued use of our Services after any changes constitutes acceptance of the new Terms. If you disagree with changes, you may terminate your account before the effective date.

11.3 Version Control

We will post the most current version of these Terms on our website with the effective date clearly indicated. Previous versions may be available upon request.
