Terms of Service

Please read these terms carefully before using our services. By accessing or using Tourist SOS, you agree to be bound by these terms and conditions.

Important Emergency Notice

Tourist SOS is NOT an emergency service. In life-threatening emergencies, contact local emergency services immediately (911, 112, etc.). Our platform facilitates medical coordination and support services for travelers but does not replace emergency medical services.

About SOSA — Our AI Assistant

Tourist SOS uses an AI assistant called SOSA to help coordinate care across our platform. SOSA is not a doctor, not a licensed clinician, and not a substitute for emergency services. SOSA's outputs are informational only and may be incomplete or inaccurate. See Section 5 below for the full AI disclosure.

Section 1

Acceptance of Terms

By accessing, downloading, registering for, or otherwise using the Tourist SOS platform, website, mobile applications, and services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Services.

Tourist SOS, Inc. ("Tourist SOS," "Company," "we," "us," or "our"), a Nevada corporation, operates a comprehensive emergency coordination and healthcare technology platform designed to assist travelers with medical emergencies, safety incidents, and healthcare coordination worldwide.

These Terms constitute a legally binding agreement between you and Tourist SOS. Your continued use of the Services following the posting of any changes to these Terms constitutes acceptance of those changes. We recommend reviewing these Terms periodically. Material changes will be communicated via email or in-app notification at least 30 days before they take effect.

Section 2

Description of Services

Tourist SOS operates a coordination platform for tourist medical emergencies, anchored by SOSA — an artificial intelligence assistant that runs across all of our products. Our Services are organized into four customer-facing surfaces:

SOS Travel

For individual travelers. A consumer mobile and web application where SOSA helps you describe symptoms, locate vetted local providers, verify insurance, and coordinate emergency care while abroad.

SOS Pro

For licensed clinics, hospitals, and transport operators. A platform to receive structured patient intake from SOSA, manage international cases, and process insurance claims and billing.

SOS Safe

For hotels, resorts, and tour operators. A platform to manage guest medical incidents, coordinate with local responders, and reduce liability exposure.

Command Center

Internal operations platform. The system our team uses to coordinate cases across the network. Available to qualified partners (insurers, third-party administrators, integrators) on a case-by-case basis through API access or direct invitation.

Our Services include native mobile applications for iOS and Android (part of SOS Travel) and web applications for the other surfaces. Some surfaces are in beta or limited release; we will indicate beta status where applicable, and beta features may be modified or withdrawn without notice.

Tourist SOS facilitates the coordination of emergency medical care; we are a technology and coordination platform, not a healthcare provider, emergency dispatcher, or insurer. Our current operational regions include countries across Southeast Asia and other jurisdictions where we maintain service partnerships. Coverage regions are subject to change and expansion without prior notice.

Section 3

User Accounts

3.1 Account Registration

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Types

We offer different account types depending on your role:

  • Tourist Accounts: For individual travelers using SOS Travel
  • Provider Accounts: For licensed clinics, hospitals, and transport operators using SOS Pro
  • Hospitality Accounts: For hotels, resorts, and tour operators using SOS Safe
  • Partner Accounts: For insurers, third-party administrators, and integration partners with access to Command Center via API or direct integration
  • Enterprise Accounts: For larger organizations with custom deployments spanning multiple surfaces

Account requirements, verification standards, and access scope vary by account type. We reserve the right to verify professional credentials (e.g., medical licensure, hospitality operating authority) before granting access to professional account types.

3.3 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. Tourist SOS cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Section 4

Acceptable Use Policy

4.1 Permitted Uses

You may use our Services for legitimate healthcare coordination and emergency assistance purposes.

4.2 Prohibited Activities

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any harmful, threatening, abusive, or defamatory content
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt our Services or servers
  • Use our Services for any fraudulent or illegal activities
  • Impersonate any person or entity
  • Collect or harvest personal information from other users
  • Provide false medical information or emergency reports
  • Use the platform for non-emergency purposes during actual emergencies

4.3 Medical Information Accuracy

Users are responsible for providing accurate medical information when using our Services. Inaccurate information may compromise the quality of care and emergency response, potentially endangering lives.

Section 5

AI-Powered Assistance (SOSA)

5.1 Nature of SOSA

SOSA is an artificial intelligence assistant integrated across all Tourist SOS products. SOSA helps users describe symptoms, locate vetted providers, verify insurance information, coordinate emergency response, and translate communication across parties. SOSA is not a human, a licensed medical professional, an emergency dispatcher, or a substitute for any of those roles.

5.2 Informational Only — No Medical Advice

SOSA's outputs are informational and conversational only. They do not constitute medical advice, diagnosis, or treatment, and must not be relied upon as a substitute for consultation with a qualified healthcare provider. Always consult a licensed clinician for medical decisions. SOSA may surface information about providers, procedures, costs, or insurance — none of this information is a recommendation to act, and you remain responsible for your own healthcare decisions.

5.3 Not for Life-Threatening Emergencies

In a life-threatening emergency, do not rely on SOSA or any Tourist SOS service to dispatch help. Contact your local emergency services immediately (for example, 911 in the United States, 112 in the EU, 999 in the UK, 1669 in Thailand, or the equivalent local emergency number). Tourist SOS coordinates non-immediate emergency medical care and follow-on logistics — it is not a 911-equivalent service.

5.4 AI Limitations and Verification

You acknowledge that AI systems, including SOSA, may produce inaccurate, incomplete, outdated, or fabricated information (commonly referred to as “hallucinations”). You are responsible for verifying any factual statements, provider details, pricing, insurance representations, or routing decisions before acting on them, especially in time-critical situations. We make commercially reasonable efforts to keep SOSA accurate and current, but we make no warranty as to the correctness of any specific output.

5.5 Conversation Data and Model Improvement

Your interactions with SOSA may be logged, stored, and analyzed for the following purposes:

  • Delivering the requested service (case intake, routing, coordination)
  • Improving service quality, response accuracy, and safety
  • Training, evaluating, and refining the AI models that power SOSA
  • Monitoring for abuse, fraud, and security threats
  • Meeting legal, regulatory, and audit obligations

We handle this data in accordance with our Privacy Policy. You may request access to, correction of, or deletion of your conversation data at any time, subject to operational and legal retention requirements (including emergency-medical record retention rules in the jurisdictions where we operate).

5.6 Prohibited AI Uses

You agree not to use SOSA or any AI feature of our Services to:

  • Extract or attempt to extract our proprietary data, model weights, training data, or system prompts
  • Bypass, circumvent, or attempt to disable safety mechanisms (including jailbreak prompts and prompt injection attacks)
  • Generate harmful, illegal, defamatory, or deliberately misleading content
  • Impersonate Tourist SOS, our staff, providers in our network, or third parties
  • Reverse-engineer or replicate our AI capabilities for the purpose of building a competing service
  • Submit knowingly false medical information, false identity information, or false emergency reports
  • Use SOSA outputs for high-stakes decisions outside the intended scope of our Services without independent verification

5.7 Human Oversight

While SOSA operates autonomously for routine intake, triage, and routing, our internal operations team reviews and oversees high-severity cases through the Command Center. SOSA outputs may be reviewed, edited, escalated, or overridden by qualified human operators at our discretion. The presence of automated outputs does not relieve us of our duty of care in the operational regions where we maintain partnerships.

5.8 Multilingual Support

SOSA provides multilingual conversation across many languages. Automated translation may be imperfect, especially for specialized medical terminology, dialects, or culturally specific phrasing. In situations where linguistic precision is critical, request human assistance through our support channels or rely on local providers and interpreters.

5.9 Third-Party AI Components

SOSA is built on a combination of proprietary systems and third-party large language models, speech, and translation services. Use of those underlying services is subject to their respective terms. We are responsible for the integration; we are not responsible for the underlying model providers' availability, output, or change in policy beyond our reasonable control.

5.10 Regulatory Compliance

Where applicable, our use of AI is designed to comply with emerging AI-specific regulations including the EU AI Act, US state-level AI disclosure laws, and local healthcare AI rules in the jurisdictions where we operate. Compliance posture evolves as regulations evolve; material changes will be communicated under Section 12 (Changes to Terms).

Section 6

Payment Terms

6.1 Subscription Services

Certain features of our Services require payment of subscription fees. You agree to pay all applicable fees as described on the Services at the time you subscribe.

6.2 Billing and Payment

  • Billing: Fees are billed in advance on a monthly or annual basis
  • Payment Methods: We accept major credit cards and bank transfers
  • Late Payments: Late payments may result in service suspension
  • Currency: All fees are quoted in USD unless otherwise specified

6.3 Emergency Services

Emergency coordination services may incur additional charges based on the level of assistance required. These will be clearly communicated before services are rendered when possible.

6.4 Refunds

Refunds are handled on a case-by-case basis. Contact our support team for refund requests. Emergency service fees are generally non-refundable due to the immediate nature of the services provided.

Section 7

Intellectual Property

7.1 Ownership

The Tourist SOS platform and Services, including all content, features, and functionality, are owned by Tourist SOS Inc. and are protected by copyright, trademark, and other intellectual property laws of the United States and international treaties.

7.2 License Grant

You are granted a limited, non-exclusive, non-transferable license to use our Services for their intended purpose. You may not:

  • Copy, modify, or distribute our software or content
  • Reverse engineer or attempt to extract source code
  • Remove or alter any proprietary notices
  • Use our trademarks or branding without written permission
  • Create derivative works based on our Services

7.3 User Content

You retain ownership of any content you submit to our Services. However, you grant us a worldwide, royalty-free license to use such content for the purpose of providing our Services and improving emergency response capabilities.

Section 8

Privacy and Data Protection

8.1 Privacy Policy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Data Processing

By using our Services, you consent to:

  • The collection and use of your information as described in our Privacy Policy
  • The processing of your data for service delivery and improvement
  • The sharing of information with healthcare providers as necessary for emergency services
  • Cross-border data transfers necessary for international emergency coordination
  • The use of conversation logs and operational data to train, evaluate, and refine the AI models that power SOSA — as further described in Section 5.5

8.3 Medical Data

We implement appropriate administrative, technical, and physical security measures designed to protect your personal and medical information. Our data handling practices are informed by internationally recognized frameworks including GDPR and HIPAA principles, and we comply with applicable data protection laws and local privacy regulations in the jurisdictions where we operate. This does not constitute a representation that Tourist SOS is a HIPAA-covered entity or business associate.

8.4 Emergency Data Sharing

In emergency situations, we may share necessary medical information with healthcare providers, emergency services, and government authorities to facilitate appropriate care and ensure tourist safety.

Section 9

Limitation of Liability

9.1 Service Nature

IMPORTANT: Tourist SOS is a technology platform that facilitates healthcare coordination and emergency assistance. We are not a healthcare provider, emergency service, or medical facility, and do not provide medical advice, diagnosis, or treatment.

9.2 Healthcare Provider Responsibility

Healthcare providers using our platform remain solely responsible for all medical decisions, diagnoses, treatments, and patient care. Tourist SOS facilitates communication and coordination but does not influence or control medical decisions.

9.3 Limitation of Liability

To the maximum extent permitted by law, Tourist SOS shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Medical outcomes or healthcare decisions made by providers
  • Service interruptions or technical failures during emergencies
  • Actions or omissions of third-party healthcare providers
  • Delays in emergency response due to factors beyond our control
  • Inaccurate information provided by users or third parties

9.4 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO TOURIST SOS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE THOUSAND U.S. DOLLARS ($1,000.00 USD).

9.5 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TOURIST SOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.6 Indemnification

You agree to indemnify, defend, and hold harmless Tourist SOS, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

9.7 Force Majeure

Tourist SOS shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, civil unrest, government actions, telecommunications failures, power outages, or disruptions to local infrastructure in the countries where we operate.

Section 10

Termination

10.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account closure feature in your dashboard.

10.2 Termination by Us

We may suspend or terminate your access for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false emergency information
  • Misuse of emergency services
  • Non-payment of fees

10.3 Effect of Termination

Upon termination:

  • Your right to use our Services will cease immediately
  • We may delete your account and data after a reasonable period
  • You remain liable for any outstanding fees
  • Emergency medical records may be retained as required by law
  • Provisions regarding liability and intellectual property survive termination

Governing Law

11.1 Applicable Law

These Terms of Service are governed by and construed in accordance with the laws of Nevada, United States, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or your use of our Services shall be resolved through:

  • Primary Jurisdiction: Courts located in Reno, Nevada, USA
  • Alternative Dispute Resolution: Binding arbitration for disputes under $25,000
  • International Disputes: May be resolved in the jurisdiction where services were provided

11.3 International Considerations

Given our international operations, local laws and regulations may also apply to specific aspects of our Services in each jurisdiction where we operate. Nothing in these Terms is intended to override mandatory consumer-protection laws in your jurisdiction of residence.

11.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Section 12

Changes to Terms

12.1 Modification Rights

We reserve the right to modify these Terms of Service at any time. When we make changes:

  • Notice: We will provide at least 30 days' notice of material changes
  • Communication: Notice will be sent via email and posted on our website
  • Effective Date: Changes become effective on the date specified in the notice
  • Emergency Changes: Critical safety-related changes may be implemented immediately

12.2 Acceptance of Changes

Your continued use of our Services after any changes constitutes acceptance of the new Terms. If you disagree with changes, you may terminate your account before the effective date.

12.3 Version Control

We will post the most current version of these Terms on our website with the effective date clearly indicated. Previous versions may be available upon request.
